Terms of Service

These Terms govern your use of apartmgreen.quest (the “Site”) and related inquiries, consulting, and vendor-introduction services provided by apartmgreen.quest, Kabushiki Kaisha (K.K.) (“we”, “us”).
1) Scope; our role
- Information & consulting: We may provide general information, feasibility guidance, and project coordination related to sustainability/energy improvements for apartments or buildings.
- Vendor introduction: Where requested, we may introduce third-party contractors, installers, suppliers, lenders, or other providers (“Vendors”). Unless we expressly agree in writing, we do not act as the Vendor, agent for the Vendor, or guarantor of the Vendor’s work.
- Separate contracts: Any installation, construction, product purchase, financing, or other on-site service is contracted directly between you and the relevant Vendor (or other stated counterparty). Their terms, warranties, and liability apply.
2) No guarantees (approvals, outcomes, savings)
Project outcomes depend on site conditions, building rules, landlord/association requirements, utility policies, budgets, and regulatory or permitting decisions. We do not guarantee: (a) approvals/permits, (b) eligibility for incentives, (c) timelines, (d) energy savings or cost reductions, or (e) that a Vendor quote will be the lowest available. Any examples or estimates are illustrative only.
To help avoid misleading representations, marketing or comparative statements should be interpreted cautiously and only as supported by the specific proposal and documentation (Act against Unjustifiable Premiums and Misleading Representations (Act No. 134 of May 15, 1962)).
3) Inquiries; user responsibilities
- You must provide accurate, current information (e.g., property details, constraints, and objectives) and promptly update it when it changes.
- You are responsible for obtaining permissions from owners/management associations and coordinating access, where applicable.
- You must review Vendor proposals and contracts carefully before agreeing; obtain professional advice (legal/engineering/tax) as needed.
4) Fees, quotes, and engagement principles
Unless we agree otherwise in writing, initial inquiries may be handled without charge. Any paid consulting, coordination, or other fee-based services will be described in a written quote, statement of work, or order confirmation specifying scope, price, and key conditions. Taxes, bank transfer charges, and Vendor pass-through costs (if any) may apply as stated in the quote.
If an online paid service order qualifies as mail order sales, required seller identity and transaction disclosures will be provided in accordance with the Act on Specified Commercial Transactions (Act No. 57 of June 4, 1976).
5) Acceptable use
- Do not misuse the Site (e.g., interfere with security or availability, attempt unauthorized access, scrape or harvest data at scale, or upload malware).
- Do not use the Site to infringe rights, violate laws, or send unlawful or unsolicited messages.
6) Intellectual property
The Site content, branding, and materials are owned by us or our licensors and may not be copied, modified, or redistributed without permission, except as allowed by law. You may share links to the Site as long as it is not misleading.
7) Privacy
We handle personal information submitted through the Site in accordance with our Privacy Policy and applicable law, including the Act on the Protection of Personal Information (Act No. 57 of 2003). If cookies/analytics are used and data is transmitted to third parties, we will describe the purposes and choices in the relevant notice.
8) Disclaimers; limitation of liability
The Site and any informational materials are provided “as is” and “as available.” To the extent permitted by applicable law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits/revenue, data, or business, arising out of your use of the Site or dealings with Vendors. Our total liability for direct damages is limited to the amounts you paid to us for the specific paid service giving rise to the claim in the 12 months before the event, if any.
9) Changes; termination
We may update these Terms by posting a new version on the Site. Continued use after changes means you accept the updated Terms. We may suspend or terminate access to the Site for security, legal, or operational reasons.
10) Governing law; venue
These Terms are governed by the laws of Japan. Any dispute arising from or relating to these Terms or the Site will be submitted to the exclusive jurisdiction of the Tokyo District Court, unless mandatory law provides otherwise.
